These Terms of Service (“Terms”) govern your use of the BeParking website, software, platform and related services (together, the “Services”) provided by BeParking Pty Ltd (“BeParking”, “we”, “us”, “our”). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance

By using our website or engaging with our car park management system, demo requests, or other offerings, you confirm that you have read, understood and accept these Terms. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

  • use the Services in any way that violates applicable laws or regulations;
  • attempt to gain unauthorised access to our systems, networks or data;
  • use the Services to transmit malware or interfere with the integrity of the Services;
  • resell, sublicense or commercially exploit the Services without our prior written consent;
  • reverse engineer, decompile or disassemble our software except where permitted by law.

3. Intellectual Property

All intellectual property rights in the Services (including BeParking OS, software, branding, content and documentation) remain the property of BeParking or its licensors. You do not acquire any rights in our IP except the limited right to use the Services in accordance with these Terms and any separate agreement we may enter with you.

4. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use and protect your information.

5. Limitation of Liability

To the maximum extent permitted by law, BeParking shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or business opportunity, arising from your use of or inability to use the Services. Our total liability for any claims arising from or related to these Terms or the Services shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim (if any).

6. Governing Law

These Terms are governed by the laws of Australia. Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Australia.

7. Changes

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Continued use of the Services after changes constitutes acceptance of the revised Terms.
